Training Club Terms.

Congratulations on your decision to join the Bioathletic Training Club. It’s a gym membership like no other and over the coming months, we’re sure you’ll agree. With our team in your corner we’ll have you recovering faster and in the best shape of your life.

WHAT YOU NEED TO KNOW ABOUT YOUR MEMBERSHIP

When does your membership start?

Your membership is current from the day you complete your trial or promotional period. We'll automatically roll you over into our regular training and you don't need to do a thing. Your first payment will be made on the following Monday for the week ahead and may include pro-rata fees for any time used prior to the initial payment.

What does my membership entitle me to?

Included in all memberships with Bioathletic Training Club is:

  • Unlimited Strength & Conditioning sessions
  • Gap-free Physiotherapy consultations
  • Gap-free Massage Therapy consultations
  • Structured Training Plan with built-in progression and overload but we’re also flexible enough to cater to your fitness level perfectly
  • Program Modifications with input from our Physiotherapy team for those weeks where you just need some downtime, or to keep you training while you work through an injury
  • Testing Weeks to chart your progress towards the Bioathletic Standard, our vision for the complete Urban Athlete
  • Online Programs to use while you’re traveling, so you never miss a session
  • Plus a bunch of extras like yoga sessions, diet workshops and more…

Can I change my mind?

A 14 day cooling-off period applies from the date you join, where you may cancel your membership immediately. No refunds will be offered on unused portions of that week's membership fees and members may be liable for an additional charge for the gap between health insurance cover and our full fees for Physiotherapy and Massage Therapy services supplied during the cooling-off period.

 

Is there a minimum term?

We invest a lot into developing a suitable plan for you from Day 1 and we’re realistic about the time it takes to achieve lasting results. For this reason, our Bioathletic Training Club requires a minimum commitment of 90 days.

Ceasing the agreement within this timeframe requires a cancelation fee equal to 50% of your remaining weekly dues, but more than that, we'd be sad to see you leave without realising your potential.

Can I pause my membership?

A membership pause can be arranged due to holiday, significant illness or financial difficulty. In all instances, the member should contact us via email at [email protected] If you are traveling, we’d love to help keep you training via our online training options.

How do I cancel my membership? 

Your membership can be cancelled with 14 days notice by sending an email to [email protected]

How does Direct Debit work?

Membership fees are debited one week in advance each Monday by the payment details you provide to us. You are responsible for:

  • ensuring your bank account or card is able to accept direct debits;
  • ensuring there is sufficient funds in your account for the payment to be made;
  • notifying us with sufficient advance notice of any changes to your direct debit details

If your membership debit is unsuccessful, we will attempt to charge your card/account again 3 days later. If still unsuccessful, a final attempt will be made 7 days after the previous attempt.

Changes to the Terms & Conditions

Bioathletic reserves the right to make changes to our terms and conditions at any time during your membership period. These changes may include but are not limited to changes in operating hours, facilities, session operations, and delivery or pricing structures. In the event that our terms and conditions change, you will be given 30 days prior notice. In such an event, the minimum membership term may be waived.

Details on service inclusions

Strength & Conditioning

  1. Members are entitled to schedule an Unlimited number of Strength and Conditioning sessions
  2. Sessions must be scheduled via our online booking system and can be made up to 4 weeks in advance

Physiotherapy

  1. Members are entitled to book sessions with our physiotherapy team for assistance in dealing with or preventing injuries
  2. Members with private health insurance rebates available will receive gap-free treatment in the event that a successful claim resulting in a minimum fund payment of $30 can be obtained at the time of service.
  3. Members without private health cover or members funds who do not satisfy the minimum claim amount will be required to pay the $30 fee. Health fund contributions that do not meet the minimum for gap-free service, will be deducted from this fee.

Massage Therapy

  1. Members are entitled to book 30-minute sessions with our Massage Therapists
  2. Members with private health insurance rebates available will receive gap-free treatment in the event that a successful claim resulting in a minimum fund payment of $30 can be obtained at the time of service.
  3. Members without private health cover or members funds who do not satisfy the minimum claim amount will be required to pay the $30 fee. Health fund contributions that do not meet the minimum for gap-free service, will be deducted from this fee.
  4. Members may choose to upgrade their 30 minute session to a 60 or 90 minute session by paying the difference between the full session rates in addition to the health fund payment.

Fair Use Policy

Bioathletic Training Club membership includes a fair use policy

Our Fair Use Policy is intended to ensure:

  • The availability of Our Services to all Bioathletic Training Club members
  • Services are not used in an unreasonable manner

Unreasonable use is defined as:

  • Scheduling sessions without the intent to attend
  • Repeated non-attendance at scheduled sessions
  • Scheduling sessions that exceed the number of sessions deemed ‘clinically necessary’ to achieve fitness outcomes

Ettiquette

  • Suitable clothing, including shoes, must be worn at all times in the gym
  • Please arrive for your allotted session with sufficient time for prep work. Sessions cannot be extended to account for late arrivals
  • Sessions are booked online on a first-come, first-served basis. We try to accommodate our member's preferences but ‘favoured’ training times cannot be guaranteed.
  • Children under the age of 16 are not permitted in the Bioathletic gym during session times
  • Anti-social behavior will not be tolerated

Health & Safety

We take your health and safety very seriously. Our team is always available to hear your concerns and if you believe there is a risk to your health by participating in any of the activities of our program, it is your duty to inform us of that risk and give full details of the risk. We strongly recommend that medical clearance is obtained prior to starting any form of exercise.

Engaging in fitness programs involves risk. Accidents can happen that may result in injury or death. By signing this document you declare that you have voluntarily read and understood this Warning, Exclusion of Liability and Release and Indemnity and accept and assume the risk of injury from participating in fitness programs carried on by Bioathletic. Be aware that any injury/accident sustained within Bioathletic should immediately be reported to a member of our team.

Exclusion of Liability

Except to the extent that terms are implied into a contract for the sale of goods and services by the Trade Practices Act 1974 or other legislation, and cannot by contract be excluded, I agree that in consideration of being allowed to participate in fitness activities of the gym that the gym and its directors, fitness professionals, employees, contractors are absolved from all liability however arising from any injury or damage however caused (Whether fatal or otherwise) due to any act of negligence to the fullest extent permitted by law (other than gross negligence), breach of duty, default and/or omission on the part of the gym.

Release and Indemnity

In consideration of Bioathletic providing me with the membership of which entitles me to engage in fitness activities of the gym, I:

  • Release and forever discharge the gym from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses, however, arising that I may have or may have had but for this release arising from or in connection with my involvement in fitness activities of the gym; and
  • Indemnify the gym to the extent permitted under the Trade Practices Act 1974 (Cth) or otherwise by law in respect to any actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses arising as a result of or in connection with my involvement in fitness activities of the gym whether caused or contributed to, directly or indirectly by any negligence to the fullest extent permitted by law (other than gross negligence), breach of duty, default and/or omission on the part of the gym.
